OFFICIAL RULES: The product review incentive giveaway begins at 12:00:00 PM PDT on November 1, 2012, and ends at 11:59:59 PM PDT on November 30, 2012. The giveaway is sponsored by Excelligence Learning Corporation (d/b/a Early Childhood Manufacturers‘ Direct) ("ELC" or “Sponsor”). Participation in the giveaway constitutes entrant‘s full and unconditional agreement to, and acceptance of, these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth herein. NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE‘S CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES OR THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER. WHERE PROHIBITED OR RESTRICTED BY LAW and is subject to applicable federal, state and local laws and regulations. Prizes awarded are as follows: three (3) Early Childhood Manufacturers‘ Direct Gift Cards valued at $50 each (three winners total).
Odds of winning will depend upon the total number of entries received. Entries generated by a robotic, programmed, script, macro or other automated means will be disqualified. Entries shall be considered made by the authorized account holder of the e-mail address submitted at the time of entry. Winners will be selected at random on December 1st. ELC will attempt to notify each potential winner by 5:00 p.m. PDT on the business day following the drawing via phone. Allow 3-4 weeks after validation of arrangement for receipt of prize.
To enter, go to http://www.ecmdstore.com (the "Web site"), during the Giveaway Period, and submit a product review or follow the instructions located here. Three winners will be drawn at random from the total list of entries received between November 1, 2012 and November 30, 2012. In order for the electronic entry to be valid, entrants must click on the "Submit" button on the Web site. Entrants must either log-in or provide a valid e-mail address to enter an online review, which e-mail addresses are subject to validation by ELC. All entries become the property of ELC and will not be aacknowledged or returned. ELC is not responsible for lost, late or illegible entries. Entrants understand that they may be contacted by Sponsor via email. Entrants may opt-out of promotional emails at any time by following the opt-out procedures as indicated in the email.
In order to receive a prize, winners may be required to provide proof of identification and sign and return a Publicity Consent and Liability Release. By submitting a completed release form within the specified timed allowed, entrants authorize ELC to use, reproduce, and publish in any of its catalogs, marketing materials, or on its websites entrant‘s name, city, center/school, likeness and/or and comments (if applicable), except where prohibited by law. Entrants will receive no compensation beyond the prize that they may receive as a giveaway winner. Prizes will be selected by ELC and shipped to winners free of charge. Entrants may not return the prize for cash, credit, or as an exchange. Entrants release and hold ELC and the employees, officers, directors, shareholders, agents, representatives of ELC, its affiliates, subsidiaries, agents and advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the giveaway or resulting from acceptance or use of any prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. There is no substitution, cash equivalent or transfer of prizes allowed. Any federal, state, and local taxes are the sole responsibility of the winners. Entrants must be legal residents of the (50) United States and the District of Columbia, over the age of 18 and are responsible for the safe and appropriate use of prizes by themselves or by any others in their care. ELC is responsible only for prize delivery; not responsible for prize utility, quality or otherwise. Manufacturers‘ instructions and warranties will apply.
If, for any reason, the selected winner cannot be contacted within seven days from the date the winner is chosen, are ineligible, fail to claim a prize, or fail to timely contact a prize representative (where required), the prize may be forfeited and an alternate winner selected. Employees or contributors to ELC (including its subsidiaries) and their immediate family and household members are not eligible to participate in the Sweepstakes. Immediate family members shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses. "Household members" shall mean people who share the same residence at least three months a year with an ELC employee or contributor. ELC and its agents are not responsible for any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the giveaway. ELC also is not responsible for any computer, online, telephone or technical malfunctions, delays or human errors that occur in the processing, transmission or receipt of entries, or for inaccurate transcription of entry information, or for entries that are stolen, misdirected, unreadable, lost or delayed by computer transmissions. If, for any reason, the giveaway is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, "Acts of God," or technical failures, ELC reserves the right at its sole discretion to cancel, terminate, modify or suspend the giveaway. ELC also reserves the right, in its sole discretion to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the entry process or the operation of the giveaway, and may prosecute or seek other legal redress against anyone suspected of engaging in these acts.
By entering, each participant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant‘s rights and obligations, or the rights and obligations of ELC in connection with the giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the state and local courts located in Monterey, California and the federal courts located in San Jose, CA.
Following the end of the giveaway, the name of the winners may be posted on the Early Childhood Manufacturers‘ Direct Web site for up to 90 days.
